These Terms and Conditions ("Terms") govern your access to and use of https://outherebymarcuschaves.com and any related services (the "Site"), including creating an account, browsing, and purchasing products from OUTHERE by Marcus Chaves ("we," "us," "our"). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. Eligibility

  • You may create an account to save preferences, view order history, manage wishlists, etc. 
  • You are responsible for maintaining the confidentiality of your login credentials and all activities under your account. 
  • Notify us immediately of unauthorized use. We reserve the right to suspend or terminate accounts for violations.

3. Products and Orders 

  • All products are subject to availability. We may limit quantities or refuse/cancel orders. 
  • Prices are in USD and exclude taxes/shipping unless stated. We reserve the right to correct pricing errors. 
  • Descriptions and images are for illustration; actual products may vary slightly.

4. Payments 

  • Payments are processed via secure third-party gateways (e.g., Shopify Payments, Shop Pay, PayPal, Stripe). 
  • By providing payment information, you authorize us (via processor) to charge the total (including taxes/shipping). 
  • You agree to pay all charges and resolve any disputes directly with the processor where applicable.

5. Fraud Prevention

  • We reserve the right to refuse, cancel, or limit any order that we suspect may involve
    fraud, unauthorized activity, or violations of these Terms. In such cases, we may attempt to contact the customer using the information provided during checkout.

6. Payments

  • Applicable sales taxes will be calculated and applied during checkout based on the shipping address and applicable tax regulations.

7. Shipping and Delivery

  • Shipping times and costs are displayed at checkout. We are not liable for delays caused by carriers or customs.
  • Risk of loss and title for products purchased from the Site transfer to you upon delivery of the items to the shipping carrier. Title passes upon full payment.

8. Returns, Refunds, and Exchanges

  • We offer returns and exchanges within 30 days of the original purchase date. Items must be unworn, unwashed, and in their original condition with all tags attached. To initiate a return or exchange, please contact us at the email address listed below. Once your return is approved, we will provide a prepaid shipping label for your return shipment.
  • Refunds will be issued to the original payment method used at checkout. Please allow 5–10 business days after we receive your returned item for the refund to be processed and reflected in your account. Processing times may vary depending on your bank or payment provider.
  • Items marked as final sale are not eligible for returns, exchanges, or refunds. Damaged or defective items may be returned outside of the standard return window; please contact us promptly if you receive a damaged or defective product.

9. Intellectual Property

  • All content (text, images, logos, designs, videos) is owned by us or licensors and protected by copyright, trademark, and other laws. Limited license granted for personal, non-commercial use only. No reproduction, distribution, or commercial use without permission.

10. User Content

  • You grant us a non-exclusive, royalty-free, perpetual, worldwide license to use, display, modify, and distribute any content you submit (reviews, photos, comments) in connection with the Site and our business.

17. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Florida, without regard to conflicts of law. Disputes shall be resolved exclusively in state or federal courts in Palm Beach County, Florida. You waive class action rights.

We may revise these Terms. Continued use after changes constitutes acceptance.
